The purpose of Adult Protective Services (APS), mandated by the Ohio Revised Code, (R.C. 5101.60), is to protect and assist adults 60 and older who may be victims of abuse, neglect, self-neglect and/or financial exploitation.
The Senior Consumer Protection Act, which helps shield seniors from financial predators. It allows senior consumers—individuals 60 years of age or older—to seek legal action against individuals who knowingly and unscrupulously obtain control of seniors’ assets and property.
In Ohio, elder abuse is “ the infliction upon an adult by self or others of injury, unreasonable confinement, intimidation, or cruel punishment with resulting physical harm, pain or mental anguish.” Ohio Rev. Code Section 5101.60(A). Elder abuse can be physical, sexual, psychological or financial.
Reporting Elder Abuse Failure of mandatory reporters to report alleged abuse, neglect, or exploitation can result in a fine or misdemeanor criminal charges. Reports of elder abuse can be made to local adult protective services or by calling 1-855-OHIO-APS (1-855-644-6277) 24 hours a day, seven days a week.
In order to prove you guilty of FELONY elder abuse under Penal Code section 368, the prosecutor must establish beyond a reasonable doubt the following: 1) you inflicted unjustifiable physical pain or mental suffering on an elder, or you allowed another person to do so; 2) you acted willfully or with criminal negligence

The Ohio Revised Code section 2151.421 mandates that certain people are required to make a report to child protective services or law enforcement if they suspect that abuse is taking place. You should report abuse or neglect even if someone tells you that it has already been reported.

If your state mandates reporting, most medical care providers have an obligation to report suspected elder abuse. If they fail to report potential abuse, they can be liable for any injuries and damages the victim may later suffer.
An APS investigator will: conduct a home visit, usually unannounced; interview other individuals who may have information about the situation; and. offer protective services if the investigator determines abuse has occurred.
Financial elder/dependent adult abuse is any theft or embezzlement of money or any other property from an elder. Taking money from a wallet, manipulating an elder to turn over money, or using an elder’s phone for long distance calls can all be considered financial abuse.
