The two officers involved, Robert McCabe and Aaron Torgalski, were suspended without pay and later charged with second-degree assault. They pleaded not guilty and are suspended with pay; officers cannot be suspended without pay for more than 30 days, according to a city spokesperson.

ALBANY – The 75-year- old man who fell to the ground after being pushed by Buffalo police officers in early June was released Tuesday from a local hospital. “75 year old Martin Gugino was pushed away after appearing to scan police communications in order to black out the equipment,” Trump said in the tweet.
Gugino was injured when two police officers shoved him backwards during a protest against racism and police brutality on June 4. Video of the incident shows that he fell to the sidewalk and his head began bleeding as other officers walked by him.
He also criticized the curfew that was in place when he went to Buffalo City Hall on June 4 and the Buffalo Police Emergency Response Team marched across the front of the building to clear it. That’s when Gugino is seen in the video approaching them and then being pushed to the ground. He fell back hitting his head.

(CNN) Martin Gugino , the 75-year-old protestor who was pushed by two Buffalo police officers in early June, has left the hospital , his lawyer Kelly Zarcone said in a statement on Tuesday. Gugino will continue his recovery at an undisclosed location to ensure privacy.
